VitalCare Cleaning Services – Terms and Conditions

Introduction

These Terms and Conditions ("Terms") govern all cleaning services provided by VitalCare Cleaning Services ("VitalCare", "we", "our", "us"). By booking or using our services, you agree to comply with these Terms.

These Terms apply to residential, commercial, post-construction, move-in/move-out, and specialized cleaning services. They cover service agreements, client obligations, liability, dispute resolution, and legal compliance.

Service Scope

• Residential cleaning
• Commercial office cleaning
• Post-construction cleaning
• Move-in/move-out services
• Specialized cleaning (e.g., deep cleaning, fumigation)

Detailed service descriptions are provided during booking, including estimated time, materials, and staff required.

Booking and Scheduling

• All bookings must be confirmed before service delivery.
• Clients may request rescheduling; VitalCare will accommodate based on staff availability.
• VitalCare may reschedule in cases of unforeseen circumstances such as inclement weather, staff shortages, or safety concerns.
• Emergency or last-minute bookings are subject to availability and additional charges.

Pricing and Payments

• Prices are based on information provided at the time of booking.
• Additional services or changes may incur extra charges.
• Payment options include cash, bank transfer, or mobile money (Mpesa).
• Advance payments may be required for large or commercial contracts.
• Receipts are provided for all transactions.

Client Obligations

• Providing safe access to premises
• Securing valuables, pets, and fragile items
• Informing VitalCare of hazards or special conditions
• Ensuring utilities such as water and electricity are available
• Supervising children and animals during service hours

Service Limitations

• VitalCare does not guarantee removal of permanent stains, mold damage, or damage caused by wear and tear.
• Services are limited to agreed areas; extra areas require additional charges.
• Clients acknowledge that results may vary based on premises condition.

Damages and Claims

• Any damages must be reported within 24 hours of service completion.
• Claims outside this window may not be accepted.
• VitalCare will assess damage and offer repair, re-clean, or refund options.
• Liability is limited to the service cost.

Limitation of Liability

• VitalCare is not liable for indirect, incidental, or consequential damages.
• Liability is limited to the amount paid for the service.
• Clients agree to indemnify VitalCare against claims arising from misuse or unsafe conditions.

Right to Refuse or Terminate Service

• VitalCare reserves the right to refuse or terminate service in unsafe, abusive, or non-compliant environments.
• Termination may occur if staff safety is at risk, property is hazardous, or client behavior is aggressive.
• No refunds are provided in cases of refusal due to safety or misconduct.

Intellectual Property

• All website content, branding, logos, documents, and training materials remain property of VitalCare.
• Clients may not reproduce, copy, or distribute materials without prior written consent.

Dispute Resolution

• Clients should contact info@vitalcare.co.ke for complaints or disputes.
• VitalCare will respond within 7 business days.
• If unresolved, disputes may be escalated to mediation or legal action under Kenyan law.

Governing Law

• These Terms are governed by the laws of the Republic of Kenya.
• Any legal action shall be brought in Kenyan courts.
